Terms & Conditions
These terms apply when you browse, register or shop on The Holiday Village. The Holiday Village is an online listing platform. We list independent creators’ stalls, take payment at checkout, and pass your order information to the relevant creator / seller. We are not the seller of the products.
By using The Holiday Village you agree to these terms. If you do not agree, please do not use the site. Purchases from independent creators are also subject to our Marketplace Terms, Returns Policy, Privacy Policy and any other policies we expressly say apply.
1. Ordering on our platform
The Holiday Village is a listing platform. Independent South African creators sell through their own stalls. When you check out, we collect payment and pass your order details (what you bought, delivery address and any personalisation) to the named creator / seller.
Each creator is solely responsible for the products they list, for preparing and dispatching their part of your order, and for arranging courier collection and delivery of their parcels. The Holiday Village does not manufacture, stock, pack or courier those goods.
2. Create an account
If you are an individual, you must be at least 18 years old to register an account and shop on The Holiday Village. You must also be legally able to enter into contracts in South Africa.
If you are a business, you may register a business account provided you are authorised to act on behalf of that business and the information you provide is accurate and up to date.
You warrant that all information you submit about yourself or your business is accurate, complete and kept current.
3. Start shopping
Choose your items, add them to your basket and proceed to checkout. Pay using one of the payment methods available at checkout.
Your order is only complete once you have paid and received an order confirmation. We then pass that order to each creator you bought from so they can prepare your items.
Adding items to your wishlist or basket does not reserve stock or guarantee that you can purchase those items later at the same price or availability.
4. Who you are buying from
You may order from one or more independent creators in a single checkout. Each product page shows which creator's stall you are buying from.
Unless a product page clearly says otherwise, you are buying from the named creator / seller — not from The Holiday Village. The contract of sale for each item is between you and that creator.
The Holiday Village provides the listing platform and checkout. We pass order information to the seller. Creators remain solely responsible for their listings, stock, lead times, dispatch, courier charges, and arranging collection and delivery of their own parcels. The Holiday Village does not act as the courier and is not responsible for the courier a creator uses.
5. Buying from creators on our platform
Creators / sellers are solely responsible for the items they sell. This includes:
- keeping product information accurate;
- ensuring items are available or made within the stated lead time;
- preparing and packaging orders properly; and
- arranging courier collection and delivery of their parcels, handing them to the courier within the time promised, and remaining responsible for that courier — not The Holiday Village.
Each creator has their own courier charge. If you buy from more than one stall, you may be charged a separate courier fee for each creator's parcel. Those charges are shown at checkout before you pay.
Because each creator runs their own stall, the same or similar products may appear from more than one creator at different prices, lead times or availability.
If you order from more than one stall in a single checkout, your items may arrive in separate parcels at different times. That is normal in the village, not a lost order.
6. Personalised and made-to-order items
Some products can be personalised or are made to order. Where personalisation is offered, you must complete the personalisation field on the product page before checkout. We pass that personalisation to the creator with your order.
Made-to-order and personalised items may take longer to prepare. The lead time shown on the product page before you buy applies to that item and is set by the creator.
Personalised and made-to-order items may not qualify for change-of-mind returns. See our Returns Policy.
7. Cancelling your order or an item
The creator / seller may cancel your order or an item after order confirmation, for example if:
- an item is out of stock or cannot be made within the stated lead time;
- payment is not received or fails;
- there is an error in the listing, including pricing;
- the order cannot be delivered to your address;
- the courier has made multiple attempts to deliver and delivery still cannot be completed; or
- your account is being investigated for fraud, abuse or breach of these terms.
The Holiday Village may also cancel an order on the platform where delivery is outside South Africa, payment fails, or we reasonably suspect fraud or abuse. We pass cancellation requests and outcomes to the relevant creator.
To request a cancellation, contact us through the contact page or your orders page. We will pass your request to the creator. Once a cancellation has been started, it may not be possible to reverse it.
If an order or item is cancelled, the amount you paid for that cancelled order or item is refunded in accordance with our Returns Policy. The creator remains responsible for the sale.

8. Promotions and discounts
Creators may offer promotions, campaigns or discounted pricing from time to time. The Holiday Village may also list platform campaigns. Any special terms will be shown on the relevant product page or at checkout.
You must meet all stated conditions to qualify for a promotion. Promotions are valid for the period shown and may end earlier if allocated stock runs out.
A creator or The Holiday Village may correct, cancel or decline a promotion where it was applied in error or misused.
9. Paying for your order
You must pay for your order using a payment method available at checkout. You must be authorised to use the payment method you select.
Payments are processed through a secure payment gateway so we can pass paid orders to creators. The payment service provider's own terms apply when you choose their method at checkout. The provider is responsible for the security of the payment process and for personal information you provide during payment, subject to our Privacy Policy.
10. Receiving your order
Orders are delivered to addresses in South Africa. Any order placed for delivery outside South Africa will be cancelled. Each creator is solely responsible for arranging courier collection and delivery of their own parcel(s). To help that go smoothly, please provide a correct delivery address and contact number, which we pass to the seller.
Delivery fees, if any, are the creator's own courier charges and are shown at checkout before you pay. Delivery fees may be updated from time to time. Current delivery information is on our delivery page.
Delivery times vary depending on the items ordered, the creator's lead time, courier operations and your delivery address. Estimates shown on product pages and at checkout are the creator's guides, not guarantees by The Holiday Village.
When your order is delivered to your chosen address or accepted on your behalf, it is considered delivered by that creator. Please ensure anyone accepting delivery on your behalf has your permission to do so.
11. When a sale is concluded
Once you have paid for an item and the creator has had it delivered to you (or collected on your behalf), that item is yours to enjoy and care for, subject to your rights under applicable law and our Returns Policy. The sale is between you and the creator.
12. Returning an item
If you want to return an item after delivery, our Returns Policy applies. Please contact us within 7 days if something arrives damaged or is not as described. We will pass that information to the creator / seller, who remains responsible for the product.
13. We own the platform and content
The Holiday Village owns and operates this listing platform. When you use the site, you receive permission to browse and shop — you do not acquire ownership of any part of the platform or its content.
Platform content (such as the site design, branding and software) belongs to The Holiday Village, its advertisers or licensors and is protected by law. You may not use, copy, distribute or reproduce it without written permission from the rights holder.
The Holiday Village does not own the products sold on the marketplace. Those products belong to the creators / sellers who list them. Creators remain solely responsible for their listings, photos and the goods they sell.
We may change, suspend or discontinue any part of the platform at any time. We will try to minimise disruption where reasonably possible.
14. Keeping your account secure
Keep your login details private. You are responsible for activity on your account, including unauthorised use if you did not take reasonable steps to protect your credentials.
If you suspect unauthorised access, contact us immediately and change your password.
We may suspend or terminate your account at any time if you breach these terms or if we reasonably believe your account is being misused.
15. Acceptable use
You agree that you will not:
- use any device, software or other means to interfere with the operation of the platform;
- use automated tools to scrape, copy or monitor the platform or its content, except where used by public search engines to index public pages; or
- use the platform to distribute material that is unlawful, defamatory, offensive, hateful or otherwise harmful.
16. Using our platform safely
The Holiday Village provides a listing platform and checkout. Like all online platforms, internet shopping carries some risks beyond our control.
Product quality, dispatch, courier performance and listing accuracy sit with the creator / seller. The Holiday Village is not the seller and does not accept responsibility for those matters.
We encourage you to:
- keep your account details secure;
- read product descriptions, lead times and creator information carefully; and
- contact us through the contact page if you have concerns — we will pass product and order issues to the relevant seller.
17. Accurate information
Creators / sellers are solely responsible for the accuracy of their listings. That includes product descriptions, photos, availability, pricing, lead times and delivery information.
The Holiday Village is a listing platform, not the seller of those products. We may remove or ask a creator to correct a listing if we become aware of an error, but we do not accept liability for loss arising from inaccurate, incomplete or outdated listing information. Any claim about a listing or a product is between you and the creator who listed it.
18. What others say on our platform
The platform includes content from creators and customers, such as product descriptions, stall stories and reviews. These reflect the views of those users, not necessarily The Holiday Village.
We are not responsible for user-generated content. Please use your own judgment when reading reviews and creator statements. Listing content is the creator's responsibility.
19. Resolving disputes
If something goes wrong with a product, listing, dispatch or courier, that dispute is between you and the creator / seller. The Holiday Village is a listing platform only. We pass information between you and the seller; we are not a party to the sale.
Please contact us through the contact page or your orders page so we can pass your message to the relevant creator.
These terms (how you use The Holiday Village as a listing platform) are governed by the laws of South Africa. The courts of South Africa have jurisdiction over disputes about use of the platform, subject to any mandatory consumer protections that apply to you. Disputes about a product or its delivery remain between you and the seller.
20. About our agreement
Our agreement with you for use of the listing platform includes:
- these Terms & Conditions;
- our Returns Policy;
- our Privacy Policy;
- our Marketplace Terms;
- payment terms shown at checkout; and
- any other rules we clearly say apply on the site.
The sale of each product is a separate agreement between you and the creator / seller of that product.
If there is a conflict between documents, these terms apply first unless we clearly state that another document should prevail for a specific matter.
We may update these terms by publishing changes on the platform. Changes take effect from the date published. Continued use of the site after a change constitutes acceptance of the updated terms.
If any part of our agreement is found invalid, the rest remains in effect. Failure to enforce a right at one time does not waive that right in future. You may not transfer your rights or obligations under these terms to anyone else without our consent.
21. Contact and legal notices
For customer enquiries, use our contact page. Contact The Holiday Village through that page. We pass product, order, delivery and complaint information to the relevant creator / seller. The Holiday Village is a listing platform only. We are not the seller and we are not liable for the products.
For formal legal notices about use of the platform, use the details on the contact page or the details we publish for legal correspondence.
We may send notices to the email address or delivery address saved on your account. You may update those details in your account.
22. About The Holiday Village
The Holiday Village is the listing platform you use to browse independent creator stalls, check out, and have your order information passed to the relevant creator / seller.
The Holiday Village is not the seller of the products. Creators / sellers own and are solely responsible for the goods they list. We are not liable for those products.

23. Lodging complaints
If you have a complaint about goods or services bought from a creator through The Holiday Village, please contact us through the contact page. We will pass the complaint to the creator / seller, who remains responsible for the product.
If you are unhappy with the outcome and your complaint has not been resolved to your satisfaction, you may contact the Consumer Goods and Services Ombud (CGSO):
